Blake Lively seeks sanctions over missing footage in Justin Baldoni lawsuit

Blake Lively accuses 'It Ends With Us' producer for holding key evidence footage

Blake Lively’s legal battle over alleged misconduct on the set of It Ends with Us has intensified, as her attorneys claim that crucial evidence is being withheld.

In a letter obtained by People magazine on November 3, the actress’s legal team asked Judge Lewis J. Liman to sanction the film’s producer, Jamey Heath, for failing to turn over specific materials he was ordered to produce by September 2.

According to the filing, Lively, 38, referred to “the video Mr. Heath showed Ms. Lively on the set of the Film of his fully nude wife during the birth of their child during an at-home birth.”

The actress alleges she was shown the footage “without warning or consent.” Lively claims Heath has only provided a three-minute excerpt of the video, which she disputes is the same clip shown to her on set.

Her lawyers assert that Heath’s team denied knowledge of any additional footage for weeks, only for Heath to reveal more material during a recent deposition.

“Yet, Mr. Heath’s counsel has refused to produce any further video on the sole basis that, in their view, the Order Compelling Production should be read exceedingly narrowly and does not require Mr. Heath to produce it,” the letter states.

Lively’s filing accuses Heath of “knowingly and willfully withholding” relevant evidence, arguing that his actions have prevented her from addressing the issue during his deposition.

She is asking the court to order Heath to turn over all related footage within three days and to bar him from giving any testimony about showing the video.

Filed on December 20, 2024, Lively’s lawsuit accuses Heath and her co-star and director, Justin Baldoni, of “disturbing” and “unprofessional” behaviour on set, including sharing “personal sexual experiences” and entering her trailer without permission.

Baldoni, 41, had countersued Lively and her husband Ryan Reynolds for $400 million in defamation, but that case was dismissed after the deadline to refile expired on October 31.

The trial in Lively’s harassment case is set for March 2026.
